Terms and Conditions of Service

THESE TERMS ARE IMPORTANT AND AFFECT YOUR LEGAL RIGHTS. PLEASE CAREFULLY READ THESE TERMS OF SERVICE PRIOR TO ENGAGING CLEANSWEEP LLC. THESE TERMS CONTAIN A BINDING ARBITRATION CLAUSE.

1. Introduction & Consent to Terms

Welcome to CleanSweep LLC (referred to as “CleanSweep”, “we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern your use of our residential and commercial cleaning services (the “Services”). By scheduling or using our Services, you acknowledge and agree to be bound by these Terms.


2. Exploring Our Services & Initial Consultation

We offer quotes based on the information you provide. All quotes are estimates only and may increase if the scope of work is larger than anticipated. If an increase is needed, we will notify you for approval before proceeding. Additional charges will be reflected in your final invoice.


3. Performance of Services

  • CleanSweep agrees to perform only the services listed in your quote. It is your responsibility to ensure all desired services are included.

  • All Services will be performed by our trained cleaners or subcontractors under our supervision.

  • Arrival times are approximate. Delays may occur, and we will communicate with you as soon as possible if changes arise.

  • We reserve the right to assign or reassign cleaners to your job. Requests for specific cleaners will be honored when possible but are not guaranteed.

  • You are responsible for providing access to the premises. Failure to do so may result in a full charge for the scheduled service.

  • If you are not present upon completion, the Services will be considered completed and accepted unless we receive a report within 48 hours.

  • All Services will be performed in compliance with applicable laws and safety standards.


4. Terms of Purchase

We offer the following service models:

  • Flat Fee Services: A fixed rate based on job type, estimated time, and labor required.

  • Hourly Services: Billed in one-hour increments at the rate quoted to you.

  • Recurring Services: Weekly or bi-weekly plans that renew automatically until canceled per these Terms.

Quotes expire after 30 days.


5. Deposits

A non-refundable deposit may be required to secure your booking. The deposit amount is determined by the scope of work and will be applied to your total balance. Services are not confirmed until the deposit is paid.


6. Payment & Billing

  • Payment is accepted via Venmo, Apple Pay, debit card, or credit card.

  • Invoices are due within 24 hours of receipt.

  • Late payments will incur 3% monthly interest. Invoices more than 30 days overdue may be sent to collections, with recovery fees and attorney’s fees applied.

  • A $50 administrative fee applies to failed or denied payments.

  • Chargebacks are not permitted. If you file a chargeback, you agree to pay $5,000 in liquidated damages, regardless of dispute outcome.

  • Recurring Services will auto-renew and auto-bill unless canceled according to these Terms.


7. Satisfaction Guarantee, Cancellations & Refunds

We stand by our work with a Satisfaction Guarantee. If you are unsatisfied, notify us within 48 hours and we will return to address the issue within another 48 hours.

  • Cancellations within 48 hours: $40 fee

  • Cancellations within 24 hours: 50% of service cost

  • Day-of service issues (e.g. no access, parking, pests, biohazards, utility outages): 100% of service cost

All sales are final and non-refundable.


8. Workplace Protections

To protect our cleaners, we do not perform:

  • Cleaning beyond the reach of a two-step ladder

  • Biohazard or pest-infested areas

  • Areas with mold or unsafe temperatures

  • Lifting items over 25 lbs

Please move heavy furniture or appliances ahead of time if cleaning behind them is required.


9. Limitations of Engagement

  • Pets: You are responsible for your pet’s safety. We are not liable unless gross negligence occurs.

  • Personal Property: We are not liable for damage to items unless you have specifically informed us of care requirements.

  • Fixtures & Decor: We are not responsible for damage to items that are not properly secured or in poor condition.


10. Reviews & Required Cure Period

  • If you are dissatisfied, you must allow CleanSweep a 72-hour cure period to address the issue before posting a negative review or public comment.

  • Posting a negative review without giving us the opportunity to fix the issue will constitute a breach of these Terms. You agree to pay $10,000 in liquidated damages to compensate for reputational harm.

  • This clause ensures fairness and a chance to resolve concerns.


11. No Solicitation of Workers

You agree not to solicit, hire, or contract directly with any CleanSweep staff or subcontractors for a period of 12 months after your last service. Each violation will incur $1,000 in liquidated damages, which is not a penalty but a fair estimate of loss.


12. Promotional Photography

You permit CleanSweep to take and use photos of work completed at your property for marketing purposes. You will not be entitled to any royalties. Identifying personal items will not be shown unless permitted.


13. Intellectual Property

CleanSweep’s website content, logos, slogans, and trademarks are protected under copyright and trademark laws. You may not use any of these without our written consent.


14. Disclaimers

ALL SERVICES ARE PROVIDED “AS IS.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. CLEANING SERVICES ARE SUBJECT TO HUMAN ERROR AND ENVIRONMENTAL VARIABLES.


15. Limitation of Liability

Our total liability to you shall not exceed the amount you paid for the Services. We are not liable for indirect or consequential damages. Any legal claims must be brought within one (1) year of the incident.


16. Indemnification

Each party agrees to defend, indemnify, and hold harmless the other from claims or damages resulting from (a) breach of these Terms, or (b) misuse of Services, including reasonable attorney’s fees.


17. General Provisions

a. Entire Agreement: These Terms are the entire agreement unless otherwise stated in writing.

b. Waiver: Failure to enforce any part of these Terms does not waive our right to enforce them later.

c. Assignment: You may not assign these Terms without our written consent.

d. Relationship: These Terms do not create a partnership or employment relationship.

e. Governing Law & Dispute Resolution: These Terms are governed by the laws of the State of Texas. Except for chargebacks or reviews without a cure period, all disputes will be resolved through binding arbitration with JAMS in Austin, Texas. The prevailing party may recover attorney’s fees.

f. Waiver of Class Action: You agree to resolve any disputes individually, not as part of a class action or group arbitration.

g. Severability: If any provision is found unenforceable, the rest remain in effect.
